OpenMedia.ca: Canada?s telecom giants go to federal court to delay new cellphone rules

As you probably know, the Big Three mobile providers, joined by SaskTel and MTS, have announced they are taking on the CRTC and Canadians in court to delay much-welcomed changes to cellphone contract lengths.
Why? In response to popular demand from Canadians, the CRTC created rules that will limit contracts to two years. They set the unambitious and entirely reasonable start date of December 2013 for all new contracts and June 2015 for all existing contracts. Despite the fact that Bell, Rogers, and Telus are making record profits and were given two years to prepare, they?re still determined to lock Canadians into expensive contracts as long as they can.
Whining to the Federal Court of Appeals in an effort to delay contract changes that put Canada on par with our global counterparts shows just how out of control Big Telecom?s sense of entitlement has become.
Here?s what you need to know:
Despite Big Telecom?s claim that they are merely trying to "clarify" the new rules, their court challenge will affect a lot of people. If they get their way, every Canadian who has signed up to a cellphone contract in the last year, or who intends to sign one before December, will be forced to remain in that contract beyond June 2015, or pay a hefty cancellation fee. This clearly goes against the letter and spirit of the CRTC?s new rules. ?
It?s also entirely reasonable for wealthy telecom giants to find a way to comply with the rules by June 2015?but it gets worse. Internet policy expert Michael Geist points out that the big cellphone providers themselves told the CRTC they should be able these new rules ?within two years?. Jean-Fran?ois Mezei (@jfmezei) also pointed out on Twitter how Big Telecom likely hopes the delay will help them impose three-year contracts through the busy back-to-school and pre-winter holiday periods when new high-demand phones will become available.
In other words, despite their record profits, the big cellphone providers just decided that they suddenly can?t comply in time because they want to retain control as long as possible.
There?s broad consensus that the big cellphone giants really stepped over the line by trying to delay changes that will benefit all Canadians. Even the prime minister weighed in against Big Telecom, posting a large graphic on his Facebook page saying: ?Canadians should be allowed to cancel their cellphone contracts after two years without cancellation fees?.
In a way this new affront on Canadians by Big Telecom isn?t surprising. Long-time OpenMedia.ca community members will know how Things Big Telecom Says rarely match up with reality. Our own Steve Anderson exposed how Telus long ago lost its credibility with its clumsy use of old data in a failed attempt to undermine complaints about their service.
Catherine Hart debunked another false claim, explaining how high cellphone bills have nothing to do with the size of Canada. But going to federal court to delay rules crafted with citizen input (they even had to name ?members of the public? in the motion they filed) is a new low even for Big Telecom. ?
Again and again, we see how Big Telecom?s false claims reveal their appalling sense of entitlement?due no doubt to the decades of government coddling they?ve benefited from. Their court case may be bad news, but in many ways it also marks the final gasp of the old-fashioned, high-cost, closed model of telecommunications that the Big Three represent.
Canadians are speaking up and demanding better and we?ve seen this movie before. Canadians have laid out a clear road map forward for our wireless future. We worked with Canadians and experts across the country to put it and the larger Time For an Upgrade report together, and we hope the Industry Minister has read it as promised and is ready to move forward. ?It?s time to open up our networks to all Canadians and new service providers.
There?s now a rapidly growing consensus that we need to look beyond Big Telecom?s closed, old-fashioned model. Canadians of all political stripes are moving on and looking forward, determined to build an open digital future for all of us. The big cell phone providers had a chance to listen to Canadians. They?ve missed that opportunity and now it?s time for them to relinquish their control over our communication networks.
As we move forward to fix our broken cellphone and telecom market we recommend Canadians hold off until December to get a new cellphone to ensure you can benefit from the new two-year contract limits. If Big Telecom is successful in their court case those who sign up before December might be stuck in a restrictive contract until nearly 2017. ?

iPhone continues to grow in the U.S. as rivals remain flat
iPhone sales continued to grow over the three-month period ending in May of this year, compared with little or no change for other platforms. The iPhone grew 3.5 percent over the same period last year, for a total of 41.9 percent of smartphone sales during the measuring period. Meanwhile, Android ticked up 0.1 percent to 52 percent, Windows Phone grew 0.9 percent to hit 4.6 percent, and all others, including BlackBerry, fell. Kantar Worldpanel ComTech attributes the iPhone's performance in this period to its official debut on T-Mobile, though that carrier was down over last year.
Kantar Worldpanel ComTech global consumer insight director Dominic Sunnebo states, ?The highly anticipated release of the iPhone on T-Mobile has benefited iOS in the latest 3 month period, though it has not yet impacted T-Mobile?s share in the market.?
Getting feature-phone users to upgrade to a smartphone appears to be the iPhone's primary strength on T-Mobile. T-Mobile had previously announced that the launch of the iPhone 5 on their network had given them one of their biggest weekends ever. Additionally, of the respondents to Kantar's survey that said that they would change phones within the next year, over a quarter of them said that an iPhone would be their next device.
This is just the latest survey that indicates that demand for the iPhone remains strong, growing substantially as rivals remain flat - despite suggestions to the contrary. While it's just one market, the United States remains particularly important to Apple, with the company placing a renewed emphasis on their home country. Apple has continually shown strong growth in the U.S. over the past few months, and while rivals like Samsung are also growing, it's at a much slower rate. The real challenge for Apple is the rest of the world, particularly getting their devices into new countries where Samsung has been selling for years.

Customise Windows 8's Copy to/Move to ribbon bar folder lists
On my previous Windows 8 install I regularly used File Explorer's Copy to and Move to ribbon bar options to copy/move files from my Download folder to other locations. This folder used to show around 10 regularly accessed folders, including Music, Pictures, Videos, etc., and so it made it very easy to quickly manage my downloads. My Backup and Album Art folders were there for example.
However, on my new Windows 8 install I've noticed that the folder list now no longer shows the folder I've been copying/moving files to be ANY and ALL folders that I've accessed, including just navigating to them and opening them. This means that the regularly used locations. such as my Album Art folder, are not being stored for long as I only have to open a folder and it will added there replacing the oldest one, even if I didn't actually copy or move anything there from the ribbon bar. Music, Pictures, Desktop, Documents and Videos are the only ones that stay fixed. I've tried to find out how to do edit or change this to how it was before but I've had no luck. It is obviously possible because that is how I had it setup before, though I don't remember doing any tweaks or anything like that to enable it.
Does anyone know how to change the behaviour of Copy to and Move to so they ONLY include locations you have actually copied or moved files to please not every folder I've merely opened?

Diplo's dancehall project got bumped from November to early in the New Year and includes collaborations with the likes of dubstepper Flux Pavillion, Wyclef Jean, Vampire Wekend's Ezra Koenig, Shaggy (yes, that Shaggy), Bruno Mars, Amber Coffman, Dev, Wynter Gordon and -- wait for it -- Tyga. Look for this release to quickly make its way toward the top of your tuned-in friend's dance party playlist. To Jamaica, and beyond!
Feb. 25 - Atoms For Peace - Amok
When Radiohead's Thom Yorke and the Red Hot Chili Pepper's Flea announced their side project, the collaboration seemed like something out of a music video game (Kobe and Jordan on the same team? Why not!). Early single "Default" has us thinking this will be much more Radiohead than RHCP.
Feb. 26 - 50 Cent - Street King Immortal
50's big return to music comes via an impressive roster of producers (Dre, Hit-Boy, Just Blaze, etc.), and who can deny that rap could use a dose of 50 Cent's witty, radio- and street-friendly hits? Early tracks have been of mixed quality, but rap fans will wait to hear the full package before judging.
March - Mariah Carey - TBA
The year 2012 was a rough one for the "All I Want For Christmas" singer. She signed on to judge "American Idol" (consider where Paula Abdul was at with her singing career when she did the same thing), was subsequently out-diva'd by Nicki Minaj and released a single that no one remembers ("Triumphant (Get 'Em)"). Her upcoming studio album will be the fourteenth of her career. Whether it's a big comeback or a swan song remains to be seen.
April - Black Sabbath - TBA
Ozzy's returning to vocal duty, so this will either be amazing or horrifying. Except that Rick Rubin's producing, so maybe more amazing?

Kevin's back and they're all living in a house together to make the album. What else needs to be said?

If "Woman's World," the lead single off Cher's first studio album since 2001's "Living Proof," is any indication, the legendary diva is setting out to make pop music that sounds like 2013. She has promised to range beyond dance tracks, so we're excited to see how her 100-ton voice sounds over stripped-down arrangements. Queen B's post-Blue Ivy return to music is shaping up to be quite a project: Jay-Z, The-Dream, Pharrell Williams and a host of other hitmakers have all been spotted in the studio with her. She's also turning the Super Bowl into a Beyonce concert with a side of football, so the stakes are pretty high. But if anyone who can pull it off ?

The band <a href="http://www.huffingtonpost.com/2012/01/04/patrick-carney-rips-nickelback-horrendous-shit_n_1183950.html">that said what everyone was thinking about Nickelback</a> <a href="http://www.huffingtonpost.com/2012/12/05/grammy-nominees-list_n_2248768.html">dialed up plenty of Grammy nominations</a> this year. We like a band that puts out quality music quickly.

It's nice that Eminem and 50 are supposedly dropping records in the same year. Eminem's shouldn't feel like that much of a comeback, but the once-fiery rapper seemed to have devolved into an inspirational life coach on his last few albums. Look for Shady to step back into the game with a vengeance (<a href="http://www.rollingstone.com/music/videos/skylar-grey-and-eminem-take-over-trailer-park-in-cmon-let-me-ride-20121211">or maybe he'll just make more pseudo-sexual jingles with Skylar Grey</a>).

Gaga sat back as everyone from Adele to Taylor Swift all but snuffed her out of the popular consciousness. Who knows if Twitter counts, but in case it does, here's what we know: The singer has said she'll keep collaborations off the studio release and that she <a href="http://www.huffingtonpost.com/2012/12/03/lady-gaga-50-songs-artpop-album_n_2231023.html">has written "like 50 songs" so far</a>. There's also a movie on deck, directed by soft-art-porn maestro Terry Richardson. Here's hoping the sifting process results in a nice collection.

Katy Perry's albums are always stacked with hits. Rumors place her next disc as dropping over summer. Let's see what Dr. Luke cooks up this time.

Pearl Jam has been fueling new-album speculation since March 2011, when members said they had some new songs ready to record. And though they may not release an album in 2013, they apparently <a href="http://loudwire.com/jeff-ament-new-pearl-jam-album-on-the-way-no-timetable-set/">have?"seven or eight" songs already on tape</a>. If a new disc does materialize, it will be the band's first since 2009's "Backspacer."

Some hints: "Cruel Summer" landed in mid-September, so perhaps "Winter" will drop just around the end of its corresponding season. That would place the record -- which will hopefully include Mr. Hudson this time -- around the latter third of March. So it goes.

Violence stalks local elections in Mexico

MEXICO CITY (AFP)Candidates have been killed and others threatened in campaigning ahead of local elections Sunday in Mexico ? the first voting since a new president took over with a pledge to reduce violence.
Analysts say the bloody run-up to the elections in 14 states is typical of past elections, and they note the assaults are taking place in areas where drug cartels want to maintain their influence.
President Enrique Pena Nieto took office in December promising to modify the security strategy of his predecessor, conservative leader Felipe Calderon, whose six-year term was marred by 70,000 drug-related deaths.
The government says killings related to organized crime are progressively falling, though analysts have voiced doubts.
Pena Nieto?s election also marked the return of the old ruling Institutional Revolutionary Party (PRI), which held the presidency non-stop for 71 years until 2000.
The new leader vowed to break with the PRI?s shady past, marked by rigged elections and repression. But the opposition has accused the ruling party of using old tricks in this campaign, like luring voters with promises of social programs.
Candidates are running for seats in state legislatures as well as mayorships and city councils in 931 of Mexico?s 2,440 municipalities. One governor?s seat, in Baja California, which has been held by Calderon?s National Action Party (PAN), is up for grabs.
Local elections are very important for drug gangs, which try to buy off or intimidate local politicians to secure their loyalty, said Raul Benitez Manaut, security expert at the National Autonomous University of Mexico (UNAM).
Cartels impose their will in order to ?be able to do business, to facilitate trafficking? and have free rein to charge protection money to local businesses, he said.
It is also a chance for criminals to tighten their grip on police forces that are already considered in their pockets.
?The renewal of almost half of the municipal authorities in the country must be considered as a national security issue. They could change half of the police chiefs,? Arturo Garcia Portillo, the PAN?s elections secretary, told AFP.
Cesar Camacho, national head of the PRI, conceded there have been very serious assaults, but he also accused opponents of staging attacks to generate ?disorder,? raising doubts over a PAN candidate?s claim he was kidnapped in Veracruz.
A half-dozen politicians or their relatives have been gunned down in recent days, while several others have reported threats. They represent a range of political parties, and it is unknown whether the attacks were related to gangs or dirty politics.
Mario Vazquez Robles, the PAN?s head in the northern state of Chihuahua, remembers being warned: ?Don?t get involved here because your life is at risk.?
In the neighboring state of Durango, Ricardo Reyes Zamudio, a mayoral candidate of the leftist Citizen Movement Party in the town of San Dimas, was found shot to death in a field on Monday after gunmen grabbed him at a funeral.
San Dimas is in a mountainous region of the northern state of Durango where drug cartels run marijuana and opium poppy fields.
Last Saturday, a PRI member running for the state legislature in the southern state of Oaxaca was wounded when gunmen attacked her car, killing her husband and assistant.
Two days earlier, the leader of the leftist Democratic Revolution Party (PRD) in Oaxaca was found dead with three gunshot wounds to the head.
The murder of a candidate in the northwestern state of Sinaloa, home to a powerful drug cartel, prompted two colleagues to drop out of mayoral and legislative elections.
The PAN withdrew from elections in two Chihuahua state municipalities, while the PRD stopped campaigns in the northeastern state of Tamaulipas and in seven Durango towns.
?Candidates are risking their skin in many parts of the country,? said security analyst Alejandro Hope, a former intelligence official, adding that, in some towns, ?good candidates don?t run, and the people are literally left under control of drug traffickers.?
